DMCA / Copyright Policy

EPonGO is built on the work of musicians, hosts, podcasters, producers, and creators of every kind. We take copyright seriously and ask Users to do the same. This page explains how copyright complaints and counter-notifications are handled on EPonGO.

1. Copyright Overview

EPonGO respects the intellectual property rights of others. Users are responsible for ensuring they have the rights necessary to upload, stream, perform, or otherwise share Content on the platform.

EPonGO responds to copyright complaints in accordance with applicable United States copyright law, including the Digital Millennium Copyright Act (the “DMCA”).

Capitalized terms used here have the meanings given in our Terms of Service.

2. Filing a Copyright Complaint

If you believe Content on EPonGO infringes a copyright you own or control, you may submit a written complaint (a “Notice”). To allow EPonGO to act on a Notice, please include:

  1. Identification of the copyrighted work you claim has been infringed.
  2. Identification of the allegedly infringing Content on EPonGO, with enough detail for us to locate it — ideally a direct URL.
  3. The location of the Content on EPonGO (for example, the page, track, profile, Stage, or other surface where it appears).
  4. Your contact information, including your full legal name, mailing address, telephone number, and a working email address.
  5. A good-faith statement that you believe the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. An accuracy statement, made under penalty of perjury, confirming that the information in your Notice is accurate and that you are the owner of the copyright at issue or are authorized to act on the owner's behalf.
  7. Your physical or electronic signature. A typed full legal name is acceptable.

Submit a Notice using our copyright complaint form, by email to copyright@epongo.com, or to the Designated DMCA Agent identified in Section 3 once registration is complete.

Submitting false or misleading information in a Notice can subject you to liability under federal law. EPonGO is not able to provide legal advice; if you are unsure whether to submit a Notice, please consult an attorney.

3. Designated DMCA Agent

EPonGO has established a copyright contact and is in the process of completing its designated DMCA agent registration with the United States Copyright Office. Pending completion of that registration, copyright owners may submit a Notice through our copyright complaint form or by email to copyright@epongo.com. This section will be updated with the designated agent's official information upon completion of registration.

4. Counter-Notification Process

If your Content was removed or disabled and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification.

A counter-notification should identify the Content that was removed or disabled and where it appeared, include your full legal name, mailing address, telephone number, and a working email address, include a statement under penalty of perjury that you have a good-faith belief the Content was removed as a result of mistake or misidentification, include a statement consenting to the jurisdiction of the applicable United States federal district court, and include your physical or electronic signature.

When EPonGO receives a valid counter-notification, we will forward it to the party that submitted the original Notice. Unless that party files a court action within the time period set by law (generally between ten and fourteen business days), EPonGO may restore the Content where permitted.

Submit a counter-notification using our counter-notification form. Submitting false or misleading information can subject you to liability under federal law.

5. Repeat Infringer Policy

Repeated copyright violations may result in account restrictions, suspension, or termination in accordance with the Repeat Infringer Policy in our Terms of Service.
